1. Who we are
The website www.art-of-tasting.com and the webshop operated on it (together: "the Website") are operated by:
The Art of Tasting, Tuinbouwstraat 98, 9717 JM, sietze@art-of-tasting.com.
In these Terms, "we", "us" and "our" refer to Art of Tasting. "You" refers to the person placing an order or using the Website.
2. Scope
These Terms apply to every visit to the Website, every offer we make and every agreement we conclude with you, unless we have expressly agreed otherwise in writing. By placing an order you accept these Terms.
If you are a consumer, nothing in these Terms limits the rights you have under mandatory consumer law. Where a provision of these Terms conflicts with those rights, the law prevails.
We may amend these Terms. The version that applies to your order is the version published on the Website at the moment you place that order.
3. Products
We sell physical products (including tasting boxes and related merchandise) and digital products (including online video courses and downloadable materials).
We describe our products as accurately as we can. Photographs, colours and packaging are illustrative; minor deviations do not entitle you to a refund on that basis alone. Product ranges and batch compositions may change.
Offers are valid while stocks last and for as long as they appear on the Website.
4. Prices and payment
All prices are shown in your local currency and exclude VAT. Shipping costs are shown before you complete your order or are stated at checkout. For deliveries outside the EU, please note you may be charged import duties or taxes by your local customs.
Obvious errors or obvious mistakes in pricing do not bind us. If we discover such an error after you have ordered, we will contact you and you may cancel the order at no cost.
Payment is made through the payment methods offered at checkout. The agreement is concluded once we have confirmed your order by email.
5. Age restriction
Some of our products contain alcohol. You must be at least 18 years old to order these products. By placing an order you confirm that you meet the minimum legal age in your country. We may ask for proof of age at delivery and may refuse or cancel an order if age cannot be established.
6. Shipping and delivery
We ship to the countries listed at checkout. Delivery times shown on the Website are estimates, not guarantees.
Unless agreed otherwise, we deliver within 30 days of the day the agreement was concluded. If we cannot deliver in time, we will inform you and you may cancel the order and receive a full refund of everything you have paid.
The risk of damage or loss passes to you at the moment you, or a third party designated by you other than the carrier, take physical possession of the goods.
If a delivery is returned to us because of an incorrect address you provided or repeated failed delivery attempts, we may charge the cost of re-shipping.
7. Right of withdrawal (14 days) and our extended return period (30 days)
7.1 Your statutory right
As a consumer you have the right to withdraw from your purchase without giving a reason within 14 days. This period starts on the day you, or a third party designated by you, receive the goods. For an order delivered in several shipments, the period starts on the day you receive the last item.
To exercise this right, inform us of your decision before the period expires by an unambiguous statement, for example by email to sietze@art-of-tasting.com. Simply returning a parcel without notifying us is not sufficient.
7.2 Our extended return period
On top of your statutory right, we voluntarily offer a return period of 30 days from the day you receive your order. The conditions in these Terms apply to the extended period as well. This extension is a commercial gesture and does not limit your statutory 14-day right in any way.
7.3 Condition of the goods
During the withdrawal period you may handle and inspect the product as you would in a physical shop, to establish its nature, characteristics and functioning. If you handle the product beyond what is necessary for that purpose, we may hold you liable for the resulting reduction in value and deduct that amount from your refund.
Please return the product with all accessories and, where reasonably possible, in the original packaging.
7.4 Products excluded from the right of withdrawal
The right of withdrawal does not apply to:
- Tasting samples. These expire within four weeks.
- Custom kits. These are personalised.
- Information booklets. These is digital content. (see section 11).
8. How to return an item
- Notify us at sietze@art-of-tasting.com within the applicable period and include your order number or another proof of purchase.
- We will confirm your return and send you the return instructions.
- Send the product, within 14 days of your notification, to: The Art of Tasting, 9717 JM Groningen, The Netherlands.
You bear the direct costs of returning the product, unless the product is defective, damaged or not what you ordered. Return shipping costs are not refunded.
For higher-value items we recommend using a tracked shipping service or taking out shipping insurance. Until we receive the product, the risk of loss or damage in transit is yours, and we can only refund what we actually receive.
9. Refunds
Once we receive and inspect your return, we will email you to confirm receipt and to tell you whether your refund is approved.
If you have withdrawn from the purchase, we will refund all payments received from you, including the standard delivery costs of the original shipment, without undue delay and in any event within 14 days of the day we were informed of your withdrawal. We may withhold the refund until we have received the goods back or until you have supplied proof of return, whichever is earlier.
Refunds are made using the same payment method you used for the original transaction, unless we agree otherwise with you. A refund never involves additional charges for you.
If a refund does not appear in your account after the period stated by your bank or card issuer, please check with them first and then contact us at sietze@art-of-tasting.com.
10. Faulty, damaged or incorrect products
You are entitled to a product that conforms to the agreement. If a product is defective, damaged in transit or not what you ordered, contact us at sietze@art-of-tasting.com within a reasonable period after you discover the problem, with your order number and photographs where possible.
Under Dutch law, a defect that becomes apparent within one year of delivery is presumed to have existed at the time of delivery, unless we prove otherwise. Depending on the situation you are entitled to repair, replacement, a price reduction or dissolution of the agreement. Your statutory rights are not affected by any commercial warranty.
Where a return is needed because of a defect, damage or an error on our side, we bear the return shipping costs.
We replace items with the same item where stock allows; if the item is unavailable we refund it.
11. Digital products and online courses
Digital products, including online video courses, are supplied as a personal, non-transferable, non-exclusive licence for your own, non-commercial use. You may not copy, share, resell, publish or make the content available to third parties, and you may not share your account credentials.
Access is provided for the period stated on the product page. We may update or improve course content over time.
Where you buy a digital product, we ask you at checkout to give your express consent to immediate access and to acknowledge that you thereby lose your right of withdrawal. Once access has been provided on that basis, the purchase is final and cannot be refunded.
You are responsible for having the internet connection and equipment needed to access digital content.
12. Gifts
We do not offer specialised gift services, gift wrapping, or gift receipts.
13. Intellectual property
All content on the Website and in our digital products, including text, photography, video, illustrations, logos and course materials, belongs to us or our licensors. You may not reproduce, distribute or otherwise use this content without our prior written permission, other than the limited personal use expressly permitted in these Terms.
14. Liability
We are liable for damage caused by our attributable failure to perform or by our unlawful act to the extent this follows from mandatory law. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for intent or deliberate recklessness on our part, or for any other liability that cannot be excluded by law.
Beyond that, our liability is limited to the amount paid for the order concerned, and we are not liable for indirect or consequential damage such as loss of profit or loss of data.
Our products are intended for responsible personal enjoyment. You are responsible for checking ingredients and allergen information stated on the product or its packaging before consumption.
15. Force majeure
We are not obliged to perform any obligation if we are prevented from doing so by circumstances beyond our control, including transport disruption, strikes, supplier failure, government measures and interruptions of internet or payment services. If such circumstances last longer than 30 days, either party may terminate the agreement and we will refund any amounts you have paid for products not delivered.
16. Privacy
We process personal data in accordance with the GDPR. How we do this is set out in our Privacy Policy.
17. Complaints and applicable law
If you are not satisfied, please contact us at sietze@art-of-tasting.com. We aim to acknowledge complaints within 2 working days and to respond substantively within 14 days. If we need longer, we will tell you when you can expect an answer.
Dutch law applies to these Terms and to every agreement between us. If you are a consumer resident in another EU member state, you also retain the protection of the mandatory provisions of the law of your country of residence.
Disputes that we cannot resolve together will be submitted to the competent Dutch court, unless mandatory law designates another court.
